On Monday, March 28, the Supreme Court (SC) requested from Attorney General (AG) Mansoor Usman Awan a summary of the rulings that the military courts had withheld. The Supreme Court declared that to decide how many defendants can be found not guilty, it should be apprised of their present circumstances. A set of intra-court appeals (ICAs) against its October 23, 2023, unanimous ruling nullifying the military trials of civilians were heard by a six-member bench led by Justice Aminuddin Khan and consisting of Justice Muhammad Ali Mazhar, Justice Syed Azhar Hasan Rizvi, Justice Shahid Waheed, Justice Musarrat Hilali, and Justice Irfan Saadat Khan.
In the instance of military courts, the court declared that the injunction order shall be altered following the summary. Justice Aminuddin questioned whether any of the defendants had been charged or could be during today’s session. “The trials were completed, but the verdicts have not yet been announced,” was the AGP’s response. The court noted, “You said some cases were of acquittal while some accused have completed their sentences.”
The AGP stated that decisions about acquittal could not be made because of the SC’s stay and that certain accused had their length of arrest taken into account while determining their sentence. Salman Akram Raja, a lawyer for the PTI, responded by saying that there was no halt on acquittals and asking the court to clear those who are eligible. It is the right of the accused who are exonerated to go free, according to Justice Aminuddin, while the remaining accused can go through the judicial system. According to the judge, “the real goal is to set those who can be set free.” Subsequently, the court postponed the hearing until March 28 and sent notices to any willing respondents in the case along with other submitted applications.
