ISLAMABAD: On Thursday, the Supreme Judicial Council (SJC) recommended that Justice Sayyed Mazhar Ali Akbar Naqvi be removed from his position as a judge after finding him guilty of wrongdoing. Per Article 2009(6) of the Constitution, the SJC issued its ruling regarding the nine complaints filed against Sayyed Mazhar Ali Akbar Naqvi, according to a news statement. It stated that on February 29, 2024, and March 1, 2024, the Supreme Judicial Council (SJC) convened.
High court and Supreme Court judges are the targets of accusations that are made public. Given that the SJC’s code of conduct, dated September 2, 2009, says in Article V that a judge should not pursue publicity, several judges have voiced worry that responding to such charges could be interpreted as misconduct. After giving the subject some thought, the SJC concluded that Article V is not violated if a judge responds or provides clarification. However since judges have voiced concerns, it was decided to add the following to Article V of the Code of Conduct: “However, a judge may respond to an allegation if it is publicized against him.”
Thus, it is altered that Article V of the Code of Conduct now says: “A judge benefits from all the publicity that comes with operating in public view.” He ought not to look for more. Specifically, he should avoid public disputes at all, especially when it comes to political matters, even if they are legal. A judge may, however, reply to any public accusations made against him.
By the press release, the SJC reviewed six distinct complaints in chronological order and recommended that there was no substance in five of them based on the opinions of the members to whom the complaint was sent. On the other hand, it stated that the SJC had given the notice to offer an explanation or respond to allegations made against a judge of the Balochistan High Court within fourteen days.
